Sub: Relieving of Railway employees in time after order for transfer in cases of request transfer.
As the Railway administrations are aware, instructions already exist which provide that in cases of request transfer, the requests should be dealt with in an organized and expeditious manner so that there is no occasion for any grievance in the mind of the staff in regard to the handling of their request.
It has been observed that despite the existence of such instructions, due to administrative exigencies, it sometimes becomes difficult to relieve the transferred employee within a reasonable time, which results in loss of seniority to the employee in his new place of posting. The loss is even greater when he goes to posts one grade below, and new recruits from subsequent batches join before him.
The loss in seniority in such cases .resulting from delayed relieving of the employee often leads to litigation, and strictures passed by Hon’ble Courts. In one such case recently, the Hon’ble CAT/Chennai in OA No.75112019 and other similar OAs, vide their common order dated 05.07.2019, inter-alia observed as under:-
Since it is submitted by the counsel for the applicants that IREC is silent on the above issue and accordingly there is a void in this regard in the policy, we deem it appropriate to direct the first respondent to consider the concern raised in the OAs as a policy issue and take an appropriate decision
on whether and if so, how the interests of such transferred employees should be protected in regard to
their seniority at least from the date from which they were approved for IR T, if they could not be relieved soon thereafter in public interest. Such policy decision may be taken and orders issued within
a period of six months from the date of receipt of a copy of this order. “

The matter has accordingly been considered in the Board. While it may not be desirable/feasible to assign seniority to transferred employee in the new unit from the date of approval of the transfer, when the employee is still actually working in the parent unit, every effort should be made to relieve her/him at an early date. Where delay in relieving of the employee after orders are issued exceeds/is likely to exceed 3 months, the case should be put up by Sr.DPO/WPO to DRM/CWM as the case may be giving specific reasons for the delay and likely date of relief.

Sub:-Modified Assured Career Progression Scheme (MACPS) for the Railways Employees-Benchmark Regarding.
Subsequent to acceptance of the recommendations of 7th CPC by the Government regarding raising the benchmark for performance appraisal for promotion and financial upgradation under MACPS from “Good” to ”Very Good”. Railway Board vide letter dated 19-12-2016 enhanced the benchmark for grant of financial upgradation under MACPS to ”Very Good” tor all posts. These changes were made effective from 25th July. 2016 i.e. from the date of resolution notified by Department of Expenditure, Ministry of Finance regarding acceptance of the recommendations of 7th CPC.
Subsequent to acceptance of the recommendations of 7th CPC by the Government regarding raising the benchmark for performance appraisal for promotion and financial upgradation under MACPS from “Good” to ”Very Good”. Railway Board vide letter dated 19-12-2016 enhanced the benchmark for grant of financial upgradation under MACPS to ”Very Good” tor all posts. On the demand raised by the Staff Side persistently in all forums including in the National Council (JCM) for revision of enhanced benchmark on prospective basis, the matter has been considered by the Board and it has been decided that APAR grading ”Good” for the period prior to 25-7-2016 i.e. the date from which the new Benchmark was made applicable. may be treated as ··very Good” while considering those cases of MACPS in which APARs for the said period are required to be taken into account.

Subject: Adoption of instructions issued by DoP&T regarding restrictions of officiating pay under FR-35 (Rule 1329 IREC Vol. II) in the context of RS(RP) Rules, 2016 in lieu of Charge Allowance.
Consequent upon the decision taken by Government of India vide MoF’s Resolution No. 1-2/2016-IC dated 25.07.2016, recommendations of 7th Central Pay Commission regarding all the Allowances (except Dearness Allowance) were referred to a Committee of Secretaries headed by the Finance Secretary. The Committee’s recommendations were implemented w.e.f. 01.07.2017 vide MoF’s Resolution No. 11-1/2016-IC dated 06.07.2017. In terms of Para 8.2.5 of 7th CPC’s Report, all the allowances not mentioned in the 7th CPC’s Report ceased to exist w.e.f 01.07.2017.

Sub:- Revision of designations of erstwhile Group ‘D’ categories
As a result of the implementation of the 6th CPC’s recommendations, the pre-revised(5th CPC) scales of Rs. 2550-3200, 2610-3540, 2610-4000 were merged and granted a common replacement pay structure of PB-1 with Grade Pay Rs. 1800/- (Corresponding to 5th CPC equivalent of Rs. 2750-4400). This is now replaced with Level-1 in the 7th CPC Pay Matrix.
2. The issue of revision/rationalisation of the designations of these erstwhile Group ‘D’ (present Level-1) categories has been under consideration in Board’s office. It has now been decided in consultation with nodal directorates in Board’s office and both recognised Staff Federations that existing designation of erstwhile Group ‘D’ categories where grades hae been merged and granted common replacement pay structure may be revised as shown in the Annexure’A’ to this letter. Suggested revised prospective medical classifications have also been indicated. It is pointed out that the issue of rationalisation of medical classification of all categories in Railways is under examination separately and the revised medical classification is suggestive. The revised designation for ‘Safaiwala’ in all departments has already been issued vide Board’s letter no. PC-III/2018/Standardization/2 dated 22-10-2018 (RBE No. 163/2018).
3. The above revision in designation & medical classification of Level-I/erstwhile Group ‘D’ categories will not entail change in the existing duties and responsibilities, appointment procedure, pay level, eligibility conditions prescribed, method of recruitment, seniority & avenue of promotion to the posts. Wherever seniority groups of merged designations are presently separate, Railways/Units may take a decision on merger (including in a phased manner) or otherwise of seniority after this revision of designations, based on local conditions and in consultation with their recognised unions.
4. If any categories in Level-1 have been left out in the list, Railways/Units may use the nearest appropriate revised designation to include the left-over category/categories, under intimation to Board’s office for record. Where any left-over category does not lend itself to be included in any of the available revised designations, full details may be intimated to Board’s office, alongwith the Raiway/Unit’s suggestions in the matter.

Subject: Implementation of the recommendations of the Seventh Central Pay Commission – Dress Allowance to officials discharging Prosecution functions on provisional basis.
Consequent to the decision taken by the Government of lndia on the recommendations of the 7th CPC, Kit Maintenance Allowance, Shoe Allowance, Uniform Allowance, Washing Allowance, Robe Allowance and Robe Maintenance Allowance have been subsumed into a single Dress Allowance and orders in this regard have been issued vide Board’s order No. PC-V!I/2017/J/7/5/7 dated 03.10.20 17 (PC-VII No. 64/ RBE No. 141/2017).
2. A separate Prosecution Cadre is also being fonned in the indian Railways. While formalisation of the Cadre is awaited, officials presently designated as Public Prosecutors and Assistant Public Prosecutors continue to perfonn prosecution related duties, including Court appearances. References are being received from Railways on payment of separate Dress Allowance to such officials as they are no longer part of the Railway Protection Force.
3. The matter has been considered in Board’s office. While the Prosecution Cadre sanction and formation is being followed up with the Department of personnel & Training, it is nevertheless a fact that Public Prosecutors/Asst. Public Prosecutors as designated presently continue to perform prosecution related duties that involve appearing in Court. Accordingly, all such Public Prosecutors/Asst. Public Prosecutors who are actually attending Courts in performance of their official duties may be paid Dress Allowance @ Rs. 10,000 per annum provisionally as governed by all instructions/tenns and conditions issued under Board’s Order No. PC-VII/2017/I/7/5/7 dt. 03.10.2017 (circulated as RBE No. 141/2017).
4. These orders will be taken up for review as and when the Prosecution Cadre is formally notified.
